Flower Mound Probate Attorney

Someone you love has recently passed away. Many questions result: If there is a Will, must the Will be recognized as genuine by the local probate court? What happens if there is no will? What will the probate process cost? Must a Personal Representative of the estate be appointed by the probate court? How long will the process take? How is title to the deceased person's property changed to the name of the ultimate recipient(s)? What debts have to be paid, and who's liable for them? What is required when property is in a trust? What if minor children are involved?

At the Law Office of Ruth Brock, our experienced attorneys can help you answer these and other questions. Our attorneys will consider the available options and will determine the most cost-effective procedure available for your fact situation. A formal probate of the estate may or may not be necessary. In Texas, several informal probate procedures may be available in lieu of a full, formal court probate proceeding. And in some cases, neither formal nor informal probate is required. If the Decedent has done estate planning, we can review those documents, including a Trust or a Will, and help select the appropriate legal path.

The Probate Process

First, a lawyer from our office will meet with you, examine the documents (Will, Trust, etc.) the decedent left, and listen carefully to the goals you define for your loved one's estate. Based upon the information you provide and your objectives, we then determine the appropriate procedure. You will be guided through every step of the process from gathering the assets of the estate and the payment of any debts or taxes to the final distribution of the estate to the heirs or beneficiaries.

If you are the personal representative of the estate, we provide you with the advice needed to perform your job with confidence. Our attorneys pride themselves on providing you with the knowledge and support to honor the financial, ethical, and legal obligations that come with this responsibility. Some of the probate processes with which our office can help you include:

  • Letters Testamentary
  • Letters of Administration
  • Affidavits of Heirship
  • Determination of Heirship, and
  • Small Estate Affidavit

Trust Transfers Without Probate

When the decedent's property is in a Trust, questions can also arise. Our attorneys have reviewed and drafted many Trusts (Revocable Trusts and Irrevocable Trusts), and can review the trust instrument and advise the successor trustee or the beneficiaries of the appropriate obligations and actions.
